Critics and fans alike have questioned whether the FX series can truly be considered a comedy or whether the show would be better suited as a drama due to its sometimes dark subject matter.

According to the Emmy nomination rules, producers can choose which category a show will be nominated in, but require final approval from the Academy’s Industry Panel.

The rules also state that for a show to be considered a comedy, it must be “primarily comedic most of the time” (at least six episodes in a season). Once a show has been placed in a particular category, “all submissions must conform to a show’s specific categorization.”

This means that if a show is submitted as a comedy, all prizes – for example for acting and directing – must be awarded in the comedy series category.
