Hendersonville sues expelled state representative over ‘illegal’ short-term rentals

HENDERSONVILLE, Tenn. (WTVF) — Despite living in communities where short-term rentals are not allowed, homeowners in some quiet Hendersonville neighborhoods must contend with strangers entering and exiting their vacation rentals.

The areas marked in red on this map show where short-term rentals are permitted. One property on Indian Lake Road and one on Breakwater North are not in this neighborhood but are available for short-term rentals.

“The people who rent – it’s not always nice to have 20 people there – can’t help it. They probably don’t know that it’s an illegal short-term rental,” said Larken Lech, a neighbor.

According to the city administration, J&J Ventures, the owner of the two problem properties, is still renting the houses even after 50 citations and subsequent fines.

We looked into it and found that guests pay about $3,000 for five nights at the house on Indian Lake Road.

“This has taken a lot of human resources from our planning, building codes, law and police departments, so many people are involved, and there comes a time when I have to advocate for the residents, and they’re fed up of living next to a motel,” said Mayor Jamie Clary.

After exhausting all options, Hendersonville filed suit against J&J Ventures LLC and its principals, Jeremy R. Durham and Jessica Durham. The city is seeking an injunction and other damages to permanently close the vacation homes.

Jeremy Durham is the former state MP who was expelled from parliament in 2016 for allegedly sexually harassing 22 women.

The city has asked the court to issue temporary and permanent injunctions. The hearing on the temporary injunctions is scheduled for September 10.
