At the start of a July 3 hearing on a lawsuit challenging the ban on vacation home rentals north of Cave Rock, District Judge Tod Young said he would not rule on whether the ban was a good idea.

Last week, Young announced his ruling dismissing the appeal, noting that substantial evidence had been presented to justify the change in the residential tenancy ordinance and that it did not amount to expropriation.

Douglas County Commissioners voted on December 21, 2023 to ban vacation home rentals north of Cave Rock Cove, except for areas covered by the Glenbrook Homeowners Association.

The ban comes into force on December 31st.

Attorney Rich McGuffin argued that the ordinance change was due to pressure from a county commissioner on behalf of a Glenbrook homeowner.

However, Young noted during the hearing that this reflected the political process and was not subject to judicial review.

While the ordinance prohibiting vacation home rentals north of Cave Rock will remain in place, an attempt to ban such rentals in residential areas will not appear on the November ballot.

On Sunday, organizers said they did not receive a district court order denying the application until July 24, nearly a month after the deadline to register to vote and about seven weeks after the hearing.

“When we got the order, there was nothing we could do,” said attorney Nancy Gilbert.

Both Gilbert and Cynthia Mohiuddin said it was possible they would try again in 2026, implementing some of the lessons learned from the last attempt.

“When you have vacation rentals across the street, the whole character of the neighborhood changes,” Gilbert said. “We see this all over the world, and communities are fed up with it.”

Members of the Vacation Rental Advisory Board will meet at 1 p.m. on Aug. 28 to discuss possible changes or updates to the county ordinance and to hear an appeal by the owner of a rental property on Milky Way Court in Stateline. The owner was fined $2,500 for renting to people under 25 years of age.
