WALMART customers who purchased certain cans of tuna may be eligible for payment if they meet the two-step criteria.

Two canned tuna manufacturers have agreed to a $3.875 million settlement to resolve a class action lawsuit.

However, customers must act quickly because the deadline for exclusion and objection ends in just two days, on August 30th.

According to the lawsuit, the two companies – StarKirst and Lion Capital – conspired with other tuna producers to raise and fix prices on food-grade tuna products weighing 40 ounces or more.

Buyers claim that because of this alleged conspiracy, they were forced to pay higher prices for these tuna products.

The settlement benefits anyone who purchased these food-sized tuna products at Walmart between June 1, 2011, and December 31, 2016.

Individuals who purchased these products at other stores such as Sam’s Club, Costco and US Foods are also eligible for payment.

The tuna companies have not admitted any wrongdoing but have agreed to pay a combined sum of several million dollars to settle the dispute.

StarKirst will pay the majority of the settlement amount, $3.6 million, and Lion Capital will pay the remaining $275,000.

WHO IS ELIGIBLE?

Individuals who believe they are entitled to a payment from the $3.875 million settlement amount should have received a postcard in the mail.

Class members who received these postcards with the qualifying purchase values ​​will receive payments based on those values.

Those who received a postcard without a qualifying purchase will not be able to receive payment from the settlement.

Because of these postcards, receipts are no longer required in this litigation.

There is no estimate of the payout amount for each individual.

The amount depends proportionally on the number of claims submitted.

Final approval of the tuna price agreement is scheduled for November 15.

Walmart customers do not need to submit an application form for this scheme.

If they do not exclude each other, they will automatically receive severance payments.

What is a class action settlement agreement?

Class action lawsuits provide an opportunity for groups of people or “classes” to join together in court.

These lawsuits are often filed by one or more individuals who allege that a corporation or other entity has wronged a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have complaints similar to those of the plaintiffs.

Companies often settle class action lawsuits by offering payments to members of the class, who typically waive their right to pursue further legal action by accepting money.

These settlement agreements often include statements from the defendant denying any wrongdoing. Companies tend to settle class action lawsuits to avoid the cost of further litigation.

Environmental pollution, discrimination or misleading advertising are just a few examples of what can lead to a class action lawsuit against a company.

Other companies involved in ongoing settlements in the United States include insurance and pension company Group 1001, dental company Great Expressions and Bank of America.

The alleged data breach by Group 1001 in February 2023 resulted in personal data being compromised.

Customers could be entitled to up to $5,000 from the $4.76 million settlement amount.

Dental care company Great Expressions is accused of allowing unauthorized access to confidential customer information in a data theft earlier this year.

Americans can receive compensation of up to $6,000 if they were affected by the February 2023 data breach.

This payment will be made from the $2.7 million settlement that Great Expressions has agreed to pay.
